Medical Neutral for Gulf Oil Spill Claim

Scores of personal injury claims will be filed in connection with the Deepwater Horizon explosion and the cleanup efforts. A thorough review of multiple levels of information will be required to determine the legitimacy of a claim, causation, record completeness and valuation. MedNeutral’s process for the medical records would involve the following:

  1. Organize, index, process and analyze the voluminous medical records

  2. Reduce medical records to online summaries for prompt search and review, with the underlying source documents available for more detailed search and review

  3. Provide access to documents to authorized users and enable electronic “sticky-notes” on the medical records (which may be shared with others or not)

  4. Highlight key descriptive information based on attorney specified requirements, such as:

Compliance with criteria for class inclusion
    • Confirm claimant’s qualification and mechanism of injury
    • Confirm geographic location and timing of exposure

    Identify symptoms expressed and contraindications
    • Identify injury or diagnosis compared to expected health impact

Review for alternate causation/mitigation of damages
    • Identify existence of other risk factors which may predispose claimant to injuries (i.e, pre-existing conditions)
    • Identify comparative negligence (i.e., ingestion of other medications)
    • Identify contributory negligence (i.e., non-compliance with prescribed medicine)

    Check record completeness
    • Identify any missing records, gaps in service and missed appointments

  5. Process and resolve Claim
    • Process descriptive information and summary through settlement matrix for expeditious resolutions, combined with certainty and transparency
