Medical Neutral for Mass Tort (Pharmaceutical) Claim
Pharmaceutical litigation requires a thorough review of multiple levels of information to determine whether a claimant is a member of the class, the legitimacy of the claim, causation and record completeness. MedNeutral would process the medical records and:
- Organize, index, process and analyze the voluminous medical records
- Reduce medical records to online summaries for prompt search and review, with the underlying source documents available for more detailed search and review
- Provide access to documents to authorized users and enable electronic “sticky-notes” on the medical records (which may be shared with others or not)
- Highlight key descriptive information based on attorney specified requirements, such as:
Compliance with criteria for class inclusion and settlement - Confirm claimant’s qualification and injury
- Confirm usage, dosage, quantity and duration within specified periods
- Check proximity of injury to dates of ingestion
Confirmation of side-effects and contraindications- Confirm side effects (e.g., heart attack, heart disease, stroke, bone fractures, peripheral edema, macular edema, vision impairment, hepatitis, rapid weight gain, jaundice, hypoglycemia or death)
Review for alternate causation- Identify existence of other risk factors which may predispose claimant to injuries, including pre-existing conditions
- Identify comparative negligence (i.e., ingestion of other medications and prescribing physician errors)
- Identify contributory negligence (i.e., non-compliance with blood pressure medication)
Check on record completeness- Identify any missing records, gaps in service and missed appointments
- Process and resolve Claim
- Process descriptive information and summary through settlement matrix for expeditious resolutions, combined with certainty and transparency
